Fast AF, Inc. (“Fast”) is now accepting referrals for top technical talent to join Fast as full-time employees. The below terms and conditions (“Terms”) govern this call for referrals (“Program”).
Fast is seeking engineers, aged eighteen (18) or older, legally permitted to work in: (a) United States of America or the District of Columbia; (b) Australia; (c) New Zealand; or (d) the United Kingdom, with current or recent past experience working at Google, Facebook, or other similar tech companies (each such engineer, a “Candidate”). Persons introducing eligible Candidates to Fast (“Referrers”) and Candidates may qualify for incentives as further described herein. Current employees or contractors of Fast or its subsidiaries are not eligible to participate in this Program.
BY PARTICIPATING IN THE PROGRAM, REFERRER AND CANDIDATE EACH AGREE TO BE BOUND BY THESE TERMS TO THE EXCLUSION OF ALL OTHER TERMS. IF THE TERMS OF THIS AGREEMENT ARE CONSIDERED AN OFFER, ACCEPTANCE IS EXPRESSLY LIMITED TO SUCH TERMS.
Referrer must obtain all necessary consents from Candidate before nominating them for employment at Fast, including without limitation a confirmation that such nomination would not violate any existing employment contract or other agreement.
Fast is offering two “Incentives” as part of the Program:
If any federal, state, or local taxes are applicable to Incentive(s), then Referrer or Candidate, as applicable, shall be solely responsible for such taxes. Fast’s records and systems shall be conclusive for purposes of determining any Incentives payable.
Qualification of referred Candidates for Incentives or for employment will be determined by Fast in its sole discretion, taking into account factors including but not limited to a Candidate’s seniority and experience, and eligibility for employment with Fast or one of its subsidiaries. Incentives under this Program will not be paid for any Candidate whose hiring is already subject to third-party compensation, such as to an executive recruiter. INCENTIVES ARE AWARDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND FAST DISCLAIMS ANY AND ALL REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE INCENTIVES.
By participating in the Program, Referrer or Candidate, as applicable, releases and holds harmless Fast, its subsidiaries, and affiliates, directors, officers, employees, contractors, attorneys, agents, vendors, and representatives from any damage, injury, death, loss, claim, action, demand, or other liability (“Claim(s)”) that exists or arises from acceptance, possession, and/or use of any Incentive or participation in the Program, regardless of whether such Claims, or knowledge of the facts constituting such Claims, exist at the time of entry or arise at any time thereafter.
Fast reserves the right to cancel or suspend the Program or to modify these Terms in any way, at any time, for any reason, with or without notice. In the event of cancelation or suspension, Fast shall promptly post a notice on this page to such effect. Any Referrer or Candidate may be disqualified from further participation in the Program for failure to comply with each provision of these Terms, or if further participation would violate applicable law, in each case as determined in the sole discretion of the Fast. All decisions or judgments by Fast are final, non-appealable, and binding with respect to all matters related to Referrers, Candidates, or the Program. Any person attempting to defraud or in any way tamper with the Program may be prosecuted to the fullest extent of the law.
These Terms contain the entire understanding of the parties and supersede any other written or oral agreements or terms relating to the subject matter contained herein. The Terms and Program are governed by the laws of the State of California, USA, without regard to conflicts of laws provisions. By participating in the Program, Referrer and Candidate agree that any dispute or litigation arising from or relating to the Program shall be resolved solely in the state or federal courts of San Francisco, CA, USA, and consents to the jurisdiction of and venue in such courts. Fast and any Referrer are not partners, joint venturers, or otherwise affiliated. Fast’s failure to enforce strict compliance with the Terms will not constitute a waiver of Fast’s right to subsequently enforce the Terms. If any provision of these Terms is held to be illegal or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect and enforceable.
